The 12th Man was not trademarked until the 90's (not sure on date, but the bottom line was after the Hawks were using it). I'll have to brush up on my law, but I didn't realize I could trademark something someone else was using, for nearly a decade... To tell you the truth, my brain is pretty mushed right now, we're probably talking about copyright protection anyhoo.

To add, the Hawks can still use the Flag... Blue, number 12, doesn't say 12th man. They can still sell jerseys that have the number 12, just not with the saying 12th man for the name. Media can still refer to it however they want... Interesting to say the least. Great timing on A&M's part, good publicity for a program that needs a shot in the arm.

From my understanding, the seahawks were not using the term while they were playing in the kingdome. So this is a relatively new thing for them.

You can call people from A&M whatever you want but snooty is the exact opposite of what you will find there. Ask anyone who has every been to aggieland if they were treated with anything else but the ut-most respect.

I have a friend that wears his 12th man t-shirt, from the Kingdome in the mid 80's... Ugly blue, tight, worn, #12, ugly as sin... Wears it every game.

There's an aritcle on ESPN.com right now talking about this issue. It says the Seahawks retired the #12 jersey in the mid 80s.

So, is A&M saying that they don't want the Seahawks to use the "12th Man" slogan because of all the profits the Seahawks might gain from the use? I'm failing to see the issue A&M has with this. More or less, doesn't it mean/represent the same thing...fan support and pride?

That is news to me. To tell you the truth, I just started reading up on the complaint this morning.

As far as looking snooty when we say "farmers fight," we may sound a bit hickish but thats about it.


Here is an article that I found on http://www.texags.com. I like the article because it states that both entities have some legitimate claims. One is that A&M may have waited too long before stating the infringement and Seattle should have respected the federal trademark/copyright. Oh well a federal court will now have to decide the fate of this case.

Seahawk fans seek share of '12th Man'

SEATTLE - As if the Terrible Towel-twirling faithful of the Pittsburgh Steelers weren't enough, now Seattle Seahawks fans have to ward off another set of rabid football partisans: the Aggies of Texas A&M.

Ever since the university launched a trademark dispute this week over who is allowed to refer to their fans as the "12th Man," David Israel has attracted plenty of abuse.

Israel is president of the Seahawks' official fan club. Aggies alumni have sent him "rude e-mails" demanding he remove the free "12th Man" computer wallpaper from the club's Web site, the same way the school wants to halt Seattle from using the "12th Man" trademarked phrase.

"Who the hell do they think they are?" R.C. Merz said while making sandwiches at a lunch counter in Pike Place Market. "They didn't invent football."

Although they don't claim rights to the actual number "12," the Aggies do hold federal trademark rights to the phrase "12th Man." A judge will take up the matter Thursday in court in Brazos County.

Isn't each player required to wear a unique number during games?

Yes. There are some teams that have expanded rosters, where to players have the same number but usual one plays defence and the other offence. I remember back in the early 90s, when UW was good for like a year, Mario Bailey wore #5 and some else wore #5 on defence.

As for Sherrill, didn't he make the bulls wear #12? or was that what he named the knife he used on them?
