Defense Seeks 'Federal Intervention' in Duke Case

Dec. 26, 2006 — The lawyers of three Duke lacrosse players who are accused of sexually assaulting a North Carolina woman have asked the U.S. attorney general to look into the prosecutor's conduct during the case, Michael Cornacchia, the attorney for defendant Collin Finnerty, told "Good Morning America."

"We're seeking federal intervention. … We can't allow this to continue another day," Cornacchia told "GMA" anchor Chris Cuomo. "Under the color of law, he's depriving our clients of constitutional rights."

Durham, N.C., District Attorney Mike Nifong announced last week that he was dropping the rape charges against the three defendants — Dave Evans, Collin Finnerty and Reade Seligmann.

Cornacchia said Nifong had mishandled the case in his identifying of the three young men, his public statements and by withholding evidence.

"He knew that the DNA didn't match before he indicted the [defendants]," Cornacchia said. [When I was a prosecutor], I didn't accuse anybody unless I had … reasonable doubt.

"Accusation is destruction," he said.

Sudden Shift in Duke Rape Case Raises Questions

Day to Day, December 26, 2006 · Rape charges were dropped Friday against three Duke University lacrosse players who had been accused of attacking an exotic dancer. The three still face kidnapping and sexual offense charges.

Many wonder why D.A. Mike Nifong is pursuing the case at all. The indicted players have all maintained their innocence, and no DNA from the players was found on their accuser.

National Journal columnist Stuart Taylor is writing a book about the case and talks with Madeleine Brand.

New verb describes trumping up charges on flimsy evidence

Given recent events in Durham concerning the alleged Duke University lacrosse "rape" case, it is now possible to declare parody dead. How does one parody a parody?

All is not lost, however. We can celebrate the addition of a new verb to our American lexicon -- "Nifong." When the moment calls for activities that need no elaboration, we already "Bobbitt," "Bork" and "Lewinsky." Now we can "Nifong" someone when we want to trump up criminal charges based on flimsy evidence allegedly for political purposes. In short, when we want to screw up someone's life.

Durham County District Attorney Michael Nifong earlier this year brought charges against three lacrosse players -- Reade Seligmann, Collin Finnerty and David Evans -- for the alleged rape of a stripper who had been hired to perform at a team party.

Stripper changes story

Last week, Nifong dropped the rape charges when the alleged victim decided she wasn't sure she had been raped after all. That is, she wasn't sure she had been vaginally penetrated, a distinction required by state law for a charge of rape.Last March, after the party, the stripper had a different recollection, telling police that she had been raped every which way. But, well, these things are difficult sometimes to keep straight. Rape being so nuanced and all.

Meanwhile, lives have been turned inside out. All because, well, let's see, because the stripper said so. The absence of corroborating evidence seemed to pose no obstacle for Nifong, who ran a successful re-election campaign.

Dec. 29, 2006 — In yet another moral blow to Durham County District Attorney Mike Nifong, the North Carolina Conference of District Attorneys called for the prosecutor to step down from the Duke lacrosse case.

The group, which represents district attorneys from across North Carolina, said in a statement that "it is in the interest of justice and the effective administration of criminal justice that Mr. Nifong immediately withdraw and recuse himself from the prosecution."

"It's extraordinarily unusual and it means a great deal," said Joshua Marquis, a district attorney in Clatsop County, Ore.

The district attorney group also called for the case to be reassigned and handed over to "another prosecutorial authority."

Headline on the front page is incorrect.

They have been invited back.

I don't think either have accepted the offer yet.

I wouldn't blame them for not returning, after the presumption of guilt the school placed on them.

Granted, where I'm from, simply throwing this kind of party would get you kicked off the team.

Raleigh Magazine Interviews Duke Lacrosse Mom

RALEIGH - A Raleigh magazine has scooped other news organizations in gaining an interview with a family member of one of the Duke lacrosse players. In a case that has been played out in the media nationally, the three Duke players are accused of sexually assaulting an exotic dancer in Durham.

The new interview appears in the January 2007 edition of Metro Magazine, a locally published glossy magazine that focuses on culture and events in Raleigh and eastern North Carolina.

Sharon Swanson performed the interview with Mary Ellen Finnerty, the mother of Collin Finnerty, one of the Duke lacrosse players. Swanson is both a writer for Metro Magazine and is also a freelance columnist for the Raleigh News & Observer newspaper.

In the article, Mrs. Finnerty talks about her son but also the strain that the Duke case has put on her family.

"A lot of joy has been taken out of our lives," said Finnerty in the article. "We've been robbed. We were a very happy family, and a monster stepped in."

Duke Lacrosse Accuser Gives Birth

Chapel Hill — WRAL has confirmed that the accuser in the Duke lacrosse case gave birth at UNC Hospitals on Wednesday.

Sources tell WRAL the woman had the baby by Cesarean section. She was not due until February.
